These terms apply to weepingforwaves.com, everything on it, and anything you buy from it (together, the “Site”). “Weeping For Waves”, “we” and “us” mean the project and the person who runs it, Jay Cook, referred to on this Site as “the writer”. By using the Site or buying from it you agree to these terms. If you don’t agree, please don’t use the Site.

1. How the music is made

Weeping For Waves is the creative vision of one writer. We want to be clear and specific about who and what makes each song:

  • Lyrics: every lyric is written by the writer, a human.
  • Concept and direction: the idea, story, mood, structure and melodic direction of each song are conceived and directed by the writer.
  • Melodies, instrumentation and accompaniment: generated with Suno, an AI music tool, from the writer’s lyrics, concepts and direction, then selected, arranged and edited by the writer.
  • Vocals: the voices of “Luna” (female) and “Cyan” (male) are AI-generated voices created with Suno. Luna and Cyan are fictional characters. They are not real people, and the writer does not sing their parts.
  • Mixing and mastering: every song is mixed and mastered by the writer.
  • Unplugged / writer’s versions: songs labelled “unplugged” or “writer’s version” are performed by the writer on guitar and voice.
  • Images: illustrations and portraits of Luna and Cyan, and some other artwork on the Site, are made with AI image tools. Portraits of Luna and Cyan depict fictional characters, not real people.

All music released as Weeping For Waves reflects the writer’s artistic vision. AI tools are used as instruments in that process. Releases are labelled as AI-assisted on streaming platforms where those platforms offer it.

2. Explicit content and mature themes

Weeping For Waves songs deal with adult themes, including desire, sexuality, longing, heartbreak, obsession, loss and other dark or intense emotions. Some songs, lyrics, artwork and videos contain explicit language, suggestive or sexual themes, and references to dark or intense subjects, and are not intended for children. Songs marked “E” are explicit, but an unmarked song may still contain suggestive or mature themes.

The Site is intended for listeners aged 18 and over. By using the Site you confirm that you are 18 or older, or that you are using it with the permission and supervision of a parent or guardian who accepts these terms on your behalf. Parents and guardians are responsible for deciding what is suitable for the children in their care and for supervising their use of the Site, streaming services and devices. You choose to listen to, read or view the content knowing it may be explicit, suggestive or upsetting, and you accept that some of it may offend you.

3. Artistic expression, not advice

The songs are works of fiction and artistic expression. Lyrics are often written from the point of view of characters, and describe feelings, situations and actions that are imagined, exaggerated or symbolic. Nothing in the music, lyrics, videos, artwork or writing on this Site is advice of any kind (including relationship, medical, psychological, legal or financial advice), an endorsement of any behaviour, or an instruction or encouragement to do anything.

You are solely responsible for how you interpret the music and lyrics and for anything you choose to do. To the fullest extent permitted by law, Weeping For Waves and the writer are not responsible or liable for any action, decision, emotional reaction, relationship outcome, or other consequence that follows from listening to, reading, sharing or interpreting any song, lyric or other content.

If a song brings up something heavy and you are struggling, please reach out to someone you trust or a local crisis line. In the United States you can call or text 988 (Suicide & Crisis Lifeline).

4. Ownership and your use of the content

The lyrics, recordings, artwork, text, logos and the “Weeping For Waves” name on this Site are owned by or licensed to Weeping For Waves and protected by copyright and other laws. You may stream previews and view the Site for personal, non-commercial use. You may share links and short excerpts on social media with credit. You may not copy, re-upload, sell, sample, remix for release, or use the music or lyrics to train AI models without our written permission.

5. Purchases

  • Payments are processed by our payment provider (Stripe or Lemon Squeezy). We never see or store your full card details. Where Lemon Squeezy is used, it acts as the merchant of record and its own buyer terms also apply.
  • You must be 18 or older, or have a parent or guardian’s permission and use their payment method with their consent, to make a purchase.
  • Prices are shown in US dollars unless stated otherwise. Taxes may be added at checkout.
  • Digital downloads (such as vault albums) are delivered immediately after payment through download links on the confirmation page. Links can be re-opened for 30 days; please save your files. Your use of downloads is governed by the download license.
  • Refunds on digital downloads: because files are delivered immediately, digital purchases are final once downloaded, except where the law gives you a right to a refund. If a file is faulty or never arrived, email orders@weepingforwaves.com and we’ll fix it or refund you.
  • Physical merchandise, when available, ships to the address you give at checkout. Shipping times, costs and any return window will be shown at checkout. Unused items in original condition can be returned within 30 days of delivery unless stated otherwise; made-to-order items can only be returned if faulty.

6. Things you send us

If you send us a word, line, story, comment or other idea (for example in response to a “finish this line” or song-request prompt), you give us a free, worldwide, perpetual permission to use, adapt and publish it, including in songs, without payment or credit unless we agree otherwise. Please don’t send anything you don’t want used this way, or anything that isn’t yours.

7. Using the Site

Don’t misuse the Site: no attempts to break, overload or scrape it, no bypassing download protections, and no unlawful use. We may change, suspend or remove any part of the Site, including products and prices, at any time.

8. Disclaimers

The Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, to the fullest extent permitted by law. Links to other services (streaming platforms, social networks, payment providers) are provided for convenience; their own terms apply and we aren’t responsible for them.

9. Limitation of liability

To the fullest extent permitted by law, Weeping For Waves and the writer will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Site, its content or any purchase. Our total liability for any claim relating to the Site or a purchase is limited to the amount you paid us for that purchase, or US$50 if you made no purchase. Some places don’t allow these limits, so they apply only as far as the law allows. You agree to indemnify us against claims arising from your misuse of the Site or breach of these terms.

10. Changes and contact

We may update these terms; the date at the top shows the latest version, and continued use means you accept the changes. These terms are governed by the laws of the place where Weeping For Waves is operated, without regard to conflict-of-law rules, and nothing in them limits rights you have under consumer law where you live.
